Terms of Service for Oboe (oboeapp.com/app)

Welcome to Oboe, a DBA of Niftic Company. These Terms of Service ("Terms") govern your access to and use of our AB testing tool and website located at oboeapp.com/app ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

  1. Acceptance of Terms

By accessing or using the Service, you represent that you are authorized to accept these Terms on behalf of yourself or your organization, and that you agree to comply with all applicable laws and regulations. If you do not have such authority, or if you do not agree with these Terms, you must not access or use the Service.

  1. Eligibility and Account Registration

2.1 Eligibility: To use the Service, you must receive an invite from Oboe or another organization user.

2.2 Account Registration: You are required to create an account to use the Service. When registering, you agree to provide accurate, current, and complete information about yourself as prompted by the registration form and to maintain and promptly update this information to keep it accurate, current, and complete.

  1. Use of the Service

3.1 Permitted Use: You may use the Service solely for lawful purposes and in accordance with these Terms.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 User Conduct: You agree not to use the Service to:

  1. Payment and Contracts

4.1 Payment Contracts: Users or organizations can enter into contracts with Oboe for payment based on usage. These contracts will outline the terms of payment and usage.

4.2 Purchases: Users cannot make purchases directly through the app. All financial transactions must be handled through the contracts agreed upon between users or organizations and Oboe.

  1. User-Generated Content and Code Changes

5.1 User-Generated Content: You may make code changes that are injected into implemented websites through the Service. You are solely responsible for the content and changes you make.

5.2 Liability: Oboe is not liable for any issues, damages, or disruptions caused by the experiments or code changes you create and implement on your site or application.

  1. Intellectual Property

6.1 Ownership: The Service and its original content, features, and functionality are and will remain the exclusive property of Oboe and its licensors.

6.2 License: Oboe grants you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

  1. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

  1. Limitation of Liability

To the fullest extent permitted by law, Oboe, its affiliates, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service. Any conduct or content of any third party on the Service. Any content obtained from the Service. Unauthorized access, use, or alteration of your transmissions or content.

  1. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Oboe makes no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

  1. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

  1. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
